It’s really too bad for the supporters of the NY SAFE law, particularly those who voted for it. But, ignorance of the law is no excuse.
“What law?” you ask…
This law:
Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Sadly the fate of the legislators who voted for this law is almost sealed. They have, perhaps unknowingly, committed a felony that has some rather severe consequences and their position as legislators (or any other government position they may hold) will not shield them as this was written to go after legislators, judges, sheriffs, governors, district attorneys, and police officers, who use the law to deprive people of their Constitutional rights. I guess if all those responsible reversed the law immediately and then resigned in disgrace we could find the mercy not to prosecute them. But if they go through with enforcing it and someone gets killed? Well then, all bets are off and everyone who helped create or enforce this law should be properly punished under existing Federal Civil Rights law.

Now, I’m sure some will think this is extreme. But what would happen if some Klan dominated legislature made it a crime to be Black and then started arresting Black people? And, if Black people were killed as a result of their refusing to go to prison quietly? Think anyone would think it is extreme to arrest the legislators, governor, and any other state official involved? Or if a state banned a religion practiced by tens of millions of Americans and started arresting anyone who refused to reject it?
